When placing an order with Al Saadah Orders Delivery Services "Al Saadah", an individual company organized and existing under the laws and regulations of the Emirate of Sharjah and holding a professional license number 735614 issued by the Economic Development Department, you, as “Sender”, are agreeing, on your behalf and on behalf of the receiver of the Shipment (“Receiver”) and anyone else with an interest in the Shipment that these Terms and Conditions shall apply. “Shipment” means all documents, food or product parcels that travel under one delivery voucher and which may be carried by any means Al Saadah chooses, road or any other carrier. A “delivery voucher” shall include any Shipment identifier or document produced by Al Saadah as well as any electronic version thereof. Every Shipment is transported on a limited liability basis as provided herein.
Claim for Loss, Damage, or Delay
ALL CLAIMS MUST BE MADE IN WRITING AND WITHIN STRICT TIME LIMITS. The right to damages against us shall be extinguished unless an action is brought within two (2) days from the date of delivery of the shipment or from the date on which the shipment should have been delivered. Within ten (10) days after notification to us of the claim, it must be documented by sending to us all relevant information about it. We are not obligated to act on any claim until all transportation charges have been paid.
The amount of any loss or damage shall not exceed AED 400.
Exceptions from Liability
The Al Saadah shall not be liable for loss, damage or delay to any of the goods described in the Delivery Voucher caused by an Act of God, riots, strikes, lockouts, labor disputes, weather related delays, a defect or inherent vice in the goods, the act or default of the consignor, owner or consignee authority of law, quarantine or differences in weights of grain, seed, or other commodities caused by natural shrinkage.
There are certain items that Al Saadah cannot accept liability for on any of our services. These include cash, notes, money orders, vouchers, credit cards, stamps, deeds, passports, tickets, travelers cheques, jewelry, precious stones, precious metals, works of art, antiques, china, glass, living creatures and any other similar valuable articles.
Al Saadah will not be held liable on any costs or penalties arising from late deliveries or missed appointments. Al Saadah is not financially responsible for the consequences of failure to deliver a shipment by a stipulated time.
Right to Inspect
Your shipment may, at our option or at the request of governmental authorities, be opened and inspected by us or such authorities at any time.
The sender shall make sure by all reasonable means that the contents of the shipment are properly placed and packed or wrapped in the container to fit the nature of the product and the mode of shipping.
Where through no fault of the Al Saadah the goods cannot be delivered, Al Saadah shall immediately give notice to the sender that delivery has not been made and shall request further instructions either re-delivery, return or disposal.A free return is granted to senders for no more than one real delivery attempt was made per shipment.
Al Saadah shall not deliver a C.O.D. shipment unless payment is received in full.
Unless otherwise stated, rates shown herein are expressed in Arab Emirates Dirhams.
Prohibited by Law
No service shall be rendered by Al Saadah in the transportation of any shipment which is prohibited by law.
Refusal of Shipments
Al Saadah reserves the right to refuse any shipment which by reason is dangerous or any other character of it’s contents is liable, in judgment of Al Saadah to soil, taint or otherwise damage other merchandise or equipment, or which is economically or operationally impracticable to transport, or which is improperly packaged, wrapped or labelled.
Al Saadah may be able to arrange insurance covering the value in respect of loss of or damage to the Shipment, provided that the Shipper so instructs Al Saadah in writingand pays the applicable premium. Shipment insurance does not cover indirect loss or damage, or loss or damage caused by delays.
Rates and charges are subject to all applicable government taxes. Rates and charges may also be subject to industry surcharges such as, but not limited to, fuel surcharges.
Any dispute arising under or in any way connected with these Terms and Conditions shall be subject to the laws of Sharjah and the UAE.
